Legal
Terms and
conditions.
The terms that apply when you use this website and our services.
- 01
Who we are
MakeMyPOA.com is operated by Brightlink Management Consultancy L.L.C., which runs this website. In these terms, “we”, “us” and “our” mean MakeMyPOA.com, while “you”, “your” and “user” mean anyone who accesses the website.
- 02
Agreeing to these terms
By accessing the website or registering on it, you agree to follow these terms and our Privacy Policy, which together form our Legal Terms. If you disagree with them, please do not access, view or use the website, and do not register as a user.
- 03
Changes to these terms
We may change the website or these Legal Terms at any time without notice, so please check them regularly to stay aware of any updates. If you keep using the website, you accept any future changes as binding on you.
- 04
Our services
We draft, translate and arrange the notarization of legal documents based on the information you give us, and you are responsible for the accuracy of the details and documents you share. Under UAE law, principals and attorneys must be 18 or older to give or receive a POA. Timelines depend on complete documents and on the authorities involved, and we will keep you informed of any delay.
- 05
Choosing and paying for a service
You can pick a service from the list on the website and pay for it through the website. We cannot guarantee that a service will achieve your objectives, because it is delivered according to the package you choose. We give no guarantee on the quality of work done by third-party service providers, and we are never liable for their negligence, errors or quality of service.
- 06
Payment, VAT and fees
We ask for the full fee upfront before work on your service begins. VAT at 5% applies to all relevant amounts, and a 3% admin fee is added if you pay through our online payment link. Each additional principal costs an extra AED 350, as does each additional asset. Any government, notary or attestation fees not included in your plan are shown in your quote.
- 07
Refunds
Refund requests are handled under our Refund Policy, which forms part of these Legal Terms. A request must be made within seven (7) days of payment, and a refund is not automatic: it depends on the work already done and any fees already paid to authorities or third parties.
- 08
Cancellations
If you cancel a service after paying, any refund is calculated as set out in our Refund Policy, after deducting the work already performed and any government, notary, third-party or payment charges already incurred.
- 09
What the website is for
The website serves as a platform through which our clients communicate with us and receive the services listed on it. Information about these services may be published by us or by other parties we authorize, either under these Legal Terms or under separate arrangements we make with them.
- 10
Who can use the website
Only people aged 18 or over may access the website. You are responsible for the internet connection and mobile device you use to access it, and for making sure that anyone who uses the website through your connection or device knows about these Legal Terms and follows them.
- 11
Using the website lawfully
You may use the website, its software and our services only for lawful purposes. In particular, do not use them in any unlawful, abusive, libellous, obscene or threatening way, or in any way these terms prohibit; to harm or try to harm minors; to upload, download, send, knowingly receive, use or reuse material that breaches these terms; or to send, or arrange for others to send, spam, meaning advertising or promotional material that was not requested or authorized.
- 12
Website availability
We aim to keep the website available 24 hours a day, but access may be suspended for a time without notice, for example because of a system failure, maintenance or repairs, or for reasons outside our control. You agree that we have no liability if the website cannot be reached, whenever that happens and however long it lasts.
- 13
Restricting access
Your permission to access the website is temporary. We may refuse or limit access by any person or organisation, temporarily or permanently, or block a particular device from reaching it, at any time, without liability and without giving any reason.
- 14
Registering an account
You can view material on the website without registering, but some areas, including our services, may only be open to registered users. The details you register with must be complete and correct, and you must let us know if they change, especially your email address. You cannot register if we have previously terminated you as a user.
- 15
One profile for all services
Once you register and create a profile, you can use our different services without signing up for each one separately. If a service you want has its own additional terms, we will ask you to accept them separately.
- 16
Keeping your account secure
You must not pretend to be someone else when registering or using the website, create multiple or false accounts, or let anyone else use your username and password (your ID). Keep your login details safe and never share them. You are responsible to us for every use of the website made with your ID, by you or anyone else, and we accept no liability, to you or to anyone else, if your ID is used without permission.
- 17
Material you must not send
Do not use the website for chain emails or spam. Nor may you send, use or reuse anything abusive, indecent, libellous, threatening or unlawful, anything that breaches copyright or another legal right, or any other illegal content.
- 18
Our content
All content on the website other than content posted by users is owned by us or by our licensors, and copyright laws worldwide protect it. Unless we expressly say otherwise, you may use it only for your own personal, non-commercial purposes, and you may not reproduce, copy, republish, post, upload, distribute or transmit any of it.
- 19
What needs our written permission
Without our written permission in advance, you may not redistribute our content (for example in a library, archive or similar service), remove a copyright or trademark notice from it, or download and store it to build a database. You also need our written consent before creating any link to or from the website.
- 20
Third-party content and trademarks
You may not copy, duplicate, alter, sell, publish, distribute, transfer or transmit content supplied by third-party providers, use it to create derivative works, or misuse it in any other way. You must follow any terms these providers set for their data or services, including signing a separate agreement directly with them where required. The website may refer to trademarks or other intellectual property owned by our partners or by third parties, but that reference does not give you any licence or right in them.
- 21
Rights we keep
We keep every right that these Legal Terms do not expressly give you. If you break these terms, you automatically lose the right to use the website and our content, and you must straight away delete or destroy any copies you have downloaded or printed.
- 22
Ratings
Ratings are the scores and comments that users post on the website, and we will ask you to rate our services at a time we consider suitable. When you post a rating, you confirm that you have used our services as a client through the website, now or in the past, that any facts you state are true, and that your opinions are genuine and honestly held.
- 23
What ratings must not contain
Ratings must not include obscene or offensive language, or anything that is or could be defamatory, abusive or hateful, that invades anyone’s privacy, that harms other users or the website’s business interests, or that encourages conduct which would be a criminal offence, create civil liability or breach any law or regulation, whether local, national or international. They must not be junk mail or advertising we have not approved, such as asking users to purchase or sell services, unless we have agreed in writing beforehand.
- 24
How we handle ratings
The website does not screen, edit or otherwise control what users post in ratings, comments or elsewhere. You accept that some of it may be offensive, inaccurate, misleading, distasteful or objectionable in other ways. We take no responsibility for preserving content on the website and may change or remove it at our sole discretion.
- 25
Forums and user content
The website may have public areas such as discussion groups, bulletin boards and chat rooms, in addition to the ratings area, where you can interact with other users and third-party service providers (forums) and post your own content (user-generated content). These forum rules apply to your ratings too, alongside the ratings rules above. Where we offer a forum, we will explain clearly what kind of service it is, and we may stop providing it at our absolute discretion, without notice or liability to you.
- 26
Content from us and our guests
Forums may also carry content from us, from businesses or from special guests we select. The views they share belong to them, and we do not necessarily agree with them; they are not professional advisers, so do not rely on anything they say. Unless stated otherwise, you must be a registered user to post content, and you alone are responsible for what you post.
- 27
What you confirm when you post
When you post content, you confirm that you are 18 or older, that you will follow any extra rules we post on a forum, that you own the content or hold a licence for it, and that you are fully entitled to give us the rights described in these Legal Terms. You also confirm that we may use it as these terms allow, including letting other users view it without any payment or royalty to you or anyone else, and that you have obtained consent and releases from everyone who can be identified in it.
- 28
Standards for your content
Any facts you state must be accurate, and any opinions must be genuinely held. Your content must not be confidential, must not infringe anyone’s intellectual property, privacy or other legal rights, and must not contain anything threatening, harassing, indecent, obscene, defamatory, libellous, abusive or unlawful. You must hold the copyright in it or be properly permitted to use it, and it must not be discriminatory or promote discrimination on grounds of age, disability, nationality, race, religion, sex or sexual orientation.
- 29
Further content standards
Your content must not ask users under 18 for personal information, break any applicable law, or, as far as you know, include a virus or any other harmful code, file or software designed to damage, interfere with, secretly intercept or take over any system, personal information or data. It must not disrupt, destroy or limit how the website or any software or equipment works, hide where it comes from, impersonate anyone, misrepresent a connection with any person or organisation, or gather or keep personal data about other users. It must not be likely to annoy, alarm, embarrass, upset or harass anyone, or suggest that it comes from someone else, including us, when it does not.
- 30
No advertising or off-topic posts
You must not post, link to or publish commercial material, content that promotes a commercial activity, advice to buy or not buy a particular service, another party’s confidential information, or anything meant to influence what services cost or are worth. Everything you post must relate to the forum and its topic.
- 31
Licence to use your content
By posting content, you give us a permanent, worldwide, exclusive and royalty-free licence to publish, distribute, translate, adapt, reproduce, make available and otherwise use it on the website, with the right to sub-license others to do the same, for any purpose we decide. You can end this licence by removing your content from the website and emailing us at makemypoa@gmail.com with full details of the content you want removed; we will try to remove it within 28 days. You also waive any moral rights you have in it and confirm that everyone else with moral rights in it has waived them.
- 32
Responsibility for what you post
You agree to cover us for any claim, cost, expense or liability, legal fees included, that arises because something you post breaches our Legal Terms. If someone claims that your content breaches their intellectual property or other legal rights, we may tell them who you are.
- 33
How forums are monitored
Forums contain content from users we have no control over, and we are unable to review every forum in full, for example to see whether content infringes someone’s copyright or other legal rights. We have no obligation to oversee or moderate forums, so we cannot guarantee that any content is accurate, intact or of good quality, and we do not endorse content that does not reflect our views. Some users may break these terms and post misleading, untrue or offensive content.
- 34
Using forums at your own risk
You accept all the risks of using the forums and should not rely on user content when making, or choosing not to make, any decision. We are not liable to you for any user content you see on the website. We do not check every post, but we may, by people or by technical means, and we may delete, move or edit your content without telling you first. We may also email you about how you use the forums.
- 35
Reporting offensive or illegal content
We do not want harmful, offensive or illegal material on the website. If you have concerns about any content, or think it is offensive or harmful, or that it breaches your rights, for example your intellectual property, email us with enough detail about where it appears; why you consider it harmful, offensive or infringing, together with a statement that you reasonably and honestly believe its use is not authorized; a description of the copyrighted work you believe is infringed, if relevant; and your contact details. Any content, whether ours or a user’s, that we reasonably believe breaches our Legal Terms will be removed without notifying you first.
- 36
Breaches and suspension
We decide, at our sole discretion, whether your use of the website breaches our Legal Terms, and we may take whatever action we consider appropriate. If you do not follow these terms or fail to act in good faith when using the website (as we alone decide), we may immediately, temporarily or permanently withdraw your right to use the website and forums, remove your content, or warn you. We may also take legal action to recover our full costs, including reasonable legal and administrative costs, on an indemnity basis, take further legal action, share information with the police or other law enforcement bodies where we reasonably think it necessary, or take any other step we reasonably consider appropriate.
- 37
Viruses, hacking and attacks
You must not misuse the website by knowingly introducing trojans, viruses, worms, logic bombs or any other harmful or malicious material, try to gain unauthorized access to the website, the server it is stored on, or any computer, server or database linked to it, or attack it with a denial-of-service or distributed denial-of-service attack. Breaking this rule ends your right to use the website at once and is a criminal offence. We will report it to the appropriate authorities and work with them, including by revealing your identity. We accept no liability if a denial-of-service attack, a virus or other harmful technology damages your computer, software, data or other material because you used the website or downloaded something posted on it or on a website linked to it.
- 38
Links to other websites
Some pages may link, directly or within frames, to websites operated by independent third parties. Where we can, we will make it clear that a link leads elsewhere, although these websites may be co-branded and display our trademarks. We have no responsibility for their availability or content, and we are not a party to, or responsible for, any transaction for goods or services offered through them, including any software, file, image or data you download from a connected website we do not operate.
- 39
Linked content and software
Whether linked content, hyperlinks or third-party pages are accurate, up to date, still available or even still exist is outside our responsibility. Links to downloadable software are included only for convenience; we are not liable for any problems or consequences of downloading it, and its use is governed by its own licence agreement, if there is one. We give no promise or warranty that any third-party software used with the website is accurate, works properly or performs well.
- 40
Advertising and sponsorship
Some parts of the website may carry advertising and sponsorship. It is up to advertisers and sponsors to make sure their material meets the applicable laws, and we accept no responsibility towards you for any mistakes or inaccuracies in their adverts.
- 41
No offer
Nothing on the website, whether it comes from us or from a third party, is an offer to sell goods or services, or a request for you to offer to buy them.
- 42
Disclaimer of warranties
The website’s content comes with no warranty whatsoever. To the fullest extent the law allows, we, our third-party content providers and their agents disclaim all express and implied warranties, including any warranty of title and any implied warranty that the website is fit for a particular purpose, and make no warranty or representation of any kind about the information on the website, which is provided “as is” and “as available”. You expressly agree that you alone carry all risk regarding how well the service performs, its quality, and whether our content is accurate and complete. Your use of our services through the website is at your own risk, and we are not responsible for losses caused by services that other users provide.
- 43
No promise of accuracy or availability
We, our third-party content providers and their agents make no condition, warranty, representation or promise, express or implied, that our content, information, materials or services are accurate, adequate, complete, reliable or timely, or that the website can be used without errors. Our content may be out of date, we have no obligation to update it, and any reliance on it is entirely at your own risk. We also do not promise the website’s availability or that it will suit your needs, that you will always be able to access it, that it will be free of delays, failures, errors or omissions, that information you send will not be lost, that it will not pass on viruses or other harmful elements, or that it will not damage your computer system. You alone are responsible for properly protecting and backing up your data and equipment and for taking sensible precautions, such as scanning for viruses and other destructive elements.
- 44
General information only
Our content and any user content are provided only as general information for your use and do not address your specific requirements. We try to keep the website current, but content may be outdated, and we are not responsible for updating it. Nothing on the website is advice, a recommendation or an arrangement from us, and you should not rely on it when making, or choosing not to make, any decision.
- 45
Limits on our liability
We are not liable to you if you rely on our content or user content, or for any deal you make with a third party named on the website, which you do entirely at your own risk and responsibility. Because our content comes from many sources and is distributed electronically over the internet, we give no warranties about the website or our services, which are provided “as is”. We disclaim all warranties, conditions and duties of every kind, except duties of good faith, including implied warranties that the services are merchantable or suitable for a particular purpose, express or statutory warranties, and warranties or duties about accuracy or timeliness, and we do not warrant that our services are free of viruses or anything else with contaminating or destructive properties.
- 46
Indirect and consequential losses
To the fullest extent the law allows, we are not liable to you or any third party for any incidental or consequential damages, such as lost business, revenue, income, profits or contracts, lost data, privacy or goodwill, any failure to perform a duty (good faith included), or indirect, punitive or special damages of any kind, that result from or relate to the website, our services or our own breach of the Legal Terms, even if we had been warned that such damages might occur. This section does not restrict any liability that the law does not allow us to exclude or limit.
- 47
Your indemnity
You agree to fully protect, defend and indemnify us and our affiliated company, together with their directors, officers, owners, agents, copyright owners and information providers, against every claim, loss, cost and expense (lawyers’ fees included) that arises from how you use or connect to the website, or from your breach of the Legal Terms.
- 48
Third-party copyright
Some content on the website, such as images and audiovisual material, may be copyrighted by third-party service providers, who keep all their rights in it. For that content, these third parties benefit from and are bound by the Legal Terms as if they were us.
- 49
Email news
We may let you sign up for an email news service. Any information you receive through it is covered by our Legal Terms.
- 50
Privacy
We use the personal information you give us only as described in our Privacy Policy, which you can open from the link on our legal pages and which does not cover third-party websites. The Privacy Policy forms part of these Legal Terms, so by accepting these terms you also agree to the way your personal information is handled under it.
- 51
General provisions
Your rights under these Legal Terms cannot be assigned, sub-licensed or transferred to anyone else. If a court with competent jurisdiction finds any term invalid, the other terms remain fully valid. If either of us does not exercise a right or remedy under these terms, that does not mean it has been waived. The headings are only there to help you read the terms and carry no legal weight.
- 52
Governing law and jurisdiction
These Legal Terms are governed by, and interpreted according to, UAE law as applied in the Emirate of Dubai. Any dispute between you and us falls under the exclusive jurisdiction of the Dubai courts, and you agree to this irrevocably.
- 53
Entire agreement
These Legal Terms are the whole agreement between you and us about how you use the website and our content. They replace everything said or agreed before on these matters, whether in writing or orally, including past dealings, discussions, representations, correspondence and other communications. You confirm that you did not rely on any promise, statement, warranty or understanding from us or anyone else that is not expressly written in these terms, and that you have no remedy for one. If any competent authority finds a provision wholly or partly invalid or unenforceable, the rest of that provision and all other provisions remain valid.
