Business POA

About Litigation POA

A litigation power of attorney lets an individual represent your company in a legal dispute, whether before the courts or an arbitration centre, in Dubai or anywhere else in the UAE. The person you appoint does not have to be one of your employees.

Your attorney can also bring in third-party experts or lawyers to deal with the dispute, take part in hearings and sign any settlement agreements needed. The POA covers legal representation only, so financial or operational decisions need a separate POA.

We draft the POA for the courts or tribunals involved and the level of authority you want to give.

Litigation POA

Your questions,
answered.

What is a litigation POA?

It is a legal document giving a lawyer or other legal representative the power to act for an individual or a company in court proceedings anywhere in the UAE.

When do I need a litigation POA?

Whenever you want someone to represent you in the UAE courts. A lawyer needs an official POA before they can bring or defend a case for someone else in front of any judicial authority in the UAE.

Can the POA be limited to one case, or cover several?

Both are possible. You can restrict it to one specific claim, such as a civil recovery, a labour dispute or a commercial arbitration, or even to enforcing a single court judgment. You can also word it to cover current and future cases.

Can a company appoint a law firm or outside lawyer under a litigation POA?

Yes. Companies registered in the UAE can issue it to a licensed law firm or an authorized legal representative, either for a particular case or for ongoing court matters.

Does a litigation POA give the lawyer access to company finances or operations?

No. It is limited to representing you in court and does not allow financial or operational decisions, which would need to be granted in a separate POA.

How long is a litigation POA valid?

It stays valid for the period stated in it. For court proceedings, though, a POA notarized recently, usually within the past 12 months, is often required.

Can I cancel a litigation POA?

Yes. Whoever issued it, whether a person or a company, can withdraw it whenever they choose by signing a notarized revocation document. The lawyer and the relevant courts must be told formally.

Is a litigation POA different from a court case POA?

They are similar. A litigation POA is usually issued by a company for business disputes, while a court case POA is more often used by individuals for personal cases.

Does it cover arbitration?

It can. A litigation POA can allow representation before arbitration centres as well as courts, and we include these powers when you need them.
