Why the question arises
Expats of every nationality and faith can marry in the UAE, and in emirates such as Dubai and Abu Dhabi you can choose between a Sharia marriage, known as Nikah, and a civil marriage. Each route has its own conditions, and some of them involve people who may not be able to attend on the day because they live abroad, are travelling or have other commitments. A marriage power of attorney can help by authorizing a named person to complete specific steps for the absent party, where the court or authority accepts representation.
The guardian’s role in a Sharia marriage
In a Sharia marriage, the bride’s guardian, called the Wali and usually her father, is expected to be present and to give his consent, as this is a condition for the marriage to go ahead. If he cannot be there, he can sign a power of attorney appointing someone to stand in for him, which confirms that he knows about the marriage and agrees to it even though he is absent. The court sets the requirements for who can act as the proxy, so confirm eligibility before the POA is drafted. A civil marriage, which is non-religious and intended mainly for non-Muslim residents and visitors, does not require the guardian to attend.
Types of marriage POA
A marriage POA is a narrow document, quite different from a general POA, and it gives no wider financial or legal authority beyond the role it describes. The wording depends on who is granting it, so decide at the outset whether the principal is a guardian or one of the spouses. Sharia ceremonies in Dubai usually expect the bride and groom to attend in person, so check with the court or marriage officer before relying on a POA for a spouse.
- Guardian POA: the Wali delegates his legal role in the marriage to another person
- Spouse POA: a husband or wife authorizes someone to handle marriage procedures for them, where the authority allows it
- In both cases, the agent can only do what the document expressly permits, while the guardian’s own authority comes from the law itself
Signing the POA inside or outside the UAE
Where the principal is when signing decides which route applies. Every marriage POA has to be notarized, and a document that is not in Arabic must be legally translated before it can be used in the UAE.
- Inside the UAE: sign before a notary public, for example at Dubai Courts, or use the online notary services of Dubai Courts, the Abu Dhabi Judicial Department or the Ministry of Justice
- Abroad: have the POA notarized in your country of residence and legalized by the relevant local authorities
- Abroad: obtain attestation from the UAE embassy there
- Abroad: complete attestation by the Ministry of Foreign Affairs once the document reaches the UAE
- In every case: arrange a certified Arabic translation if the POA is written in any other language
Documents to gather
Exact requirements differ by emirate and by type of marriage, so confirm them with the relevant court before you begin. For the POA itself, you will usually be asked for the following.
- Valid passports for everyone named, plus Emirates IDs for UAE residents
- Full details of the agent and of both spouses as they will appear in the document
- Proof of guardianship where the POA is granted by a Wali
- Attested and translated copies of any documents issued abroad
Other Sharia marriage requirements to keep in mind
The POA is only one part of the file for a Sharia marriage in Dubai. Couples also typically need a premarital medical screening certificate issued by an approved health facility in the UAE, as well as witnesses who meet the court’s requirements. A divorced bride provides her divorce certificate and a widowed bride the death certificate of her late husband, attested and translated if issued abroad. If the bride’s father has passed away or is unavailable, the court decides who may act as her guardian, and some cases need extra documents, such as an embassy no-objection certificate.
Tips to avoid delays
Most rejections come from small errors that are easy to prevent, so review the draft carefully before anyone signs it. A few simple checks will save you time at the court.
- State the powers you are granting precisely and identify every party clearly
- Make sure names and ID numbers match the passports exactly
- Allow extra time if the POA is being signed abroad, as attestation involves several offices
- Bring the final POA together with the standard marriage application to the court or authorized marriage officer
